According to reports, Nwabueze's academic pursuit started at the CMS Central School Atani, from 1938 – 1945; C.M.S Central School, Onitsha (formerly, African College), 1947 – 1950. He later went to London School of Economics and Political Science, University of London, 1956 – 1961 and School of Oriental and African Studies, University of London, 1961 – 1962. From 1962 – 1965, he was Senior Lecturer at Holborn College of Law, London, and Senior Lecturer, University of Nigeria Nsukka, between 1967 – 1970. In 1971, he was Dean, Faculty of Law, University of Zambia and Director, Law practice Institute, Zambia, 1973 – 1975

The Supreme Court judgement did not HELP fulfill his desire to see Atiku as President. That must have been devastating to him. RIP

The first Nigeria's academic Senior Advocate of Nigeria (SAN), Prof. Ben Nwabueze, has died.

This is coming ten years after the legal luminary had begged God to give him more five years to finish his works on earth before calling him home.

Prof. Nwabueze had made the call in 2013 during the presentation of his two-volume autobiography titled: “Ben Nwabueze, His Life, Works, Times - An Autobiography,”

Howbeit, the popular constitutional lawyer, died on Sunday, at the age of 92 years.


Prof. Nwabueze, a one-time Secretary General of Ohanaeze Ndigbo Worldwide, who hailed from Atani in Ogbaru Local Government Area of Anambra State, was said to have passed on in his hometown.

Until his death, he was a teacher, administrator, businessman and former Minister of Education and Youth Development.

According to reports, Nwabueze's academic pursuit started at the CMS Central School Atani, from 1938 – 1945; C.M.S Central School, Onitsha (formerly, African College), 1947 – 1950. He later went to London School of Economics and Political Science, University of London, 1956 – 1961 and School of Oriental and African Studies, University of London, 1961 – 1962. From 1962 – 1965, he was Senior Lecturer at Holborn College of Law, London, and Senior Lecturer, University of Nigeria Nsukka, between 1967 – 1970. In 1971, he was Dean, Faculty of Law, University of Zambia and Director, Law practice Institute, Zambia, 1973 – 1975

Although, well supported by both father and uncle initially, the greater part of his Academic pursuits abroad were made possible by scholarship awarded to him for his academic excellence.

Prof. Nwabueze earned his Doctor of Laws (LL.D) at the University of London in 1978, based on his three outstanding books – Constitutionalism, Presidentialism, and Judicialism, thus entering the record books as the second (since the death of Dr. T.O. Elias), the only Nigerian and African holder of a higher doctorate degree in Law by published works.

He is also the first academic lawyer to be made a Senior Advocate of Nigeria (SAN) in 1978 strictly on the basis of his published works.

A seasoned Academician, he was member of Senate of the Universities of Lagos, Dar-es-salaam, Nairobi, Haile Selassie in Ethiopia, Lesotho, Botswana and Swaziland between 1971 – 1978.

He was appointed the University Assessor for Academic Appointments, Universities of Ghana, Lagos, Ife (now Obafemi Awolowo University) and Jos between 1978 – 1979.

A firm believer in publishing, Prof. Ben Nwabueze is the proud author of over thirty books and treatises with an average extent of 400 pages. They include; The Machinery of Justice in Nigeria; Constitutional Law of the Nigerian Republic; Nigerian Land Law and Constitutionalism in the Emergent States. Others are Presidentialism in Commonwealth Africa, Judicialism in Commonwealth Africa; The Presidential Constitution of Nigeria; A Constitutional History of Nigeria; Federalism in Nigeria under the Presidential Constitution; and Nigeria’s Second Experiment in constitutional Democracy in Africa in Five Volumes.

He has written over 200 articles in academic journals and more than 100 keynotes at local and international conferences.

Prof. Nwabueze had long been partially incapacitated with age and ill-health, until the news of his demise.

Google it. Decree 34. Not only did he draft decree 34…the most controversial decree in Nigerias history, He also drafted the decree that gave rise to the ING after June 12 was annulled .

The person who destroyed Regionalism in Nigeria and introduced unitary rule was Yakubu Gowon who abolished Nigerias 4 Regions with Decree 14, the created 12 states to replace them. Gowon the took away resource control with Decree 15

you are clearly very naive. Ask those who were around and are more knowledgeable. Gowon merely took it further and created states in a bid to check mate Ojukwu. Ojukwu then hurredly declared seccesion before the new states could come into being knowing full well that once the governors of the new states took office he is powerless. It's like your children in the future saying there was local government autonomy in 2023 because of what is in the law, you and i know there is no such thing.

As from the appointed day—

the Federal Military Government and the Federal Executive Council shall be known respectively as the National Military Government and The Executive Council;
the Federal territory shall be known as the Capital territory;
the provinces, including Kaduna capital territory, in schedule 1 of this Decree which immediately before the appointed day were respectively comprised in Northern Nigeria, Eastern Nigeria, Western Nigeria and Mid-Western Nigeria shall be known respectively as the Northern group of Provinces, the Eastern group of Provinces, the Western group of Provinces and the Mid-Western group of Provinces;
for the purpose of administration each group of provinces shall subject to the authority of the Head of the National Military Government, be under the general direction and control of a Military Governor appointed by the Head of the National Military Government;

3. 1. As from the appointed day all offices in the service of the Republic in a civil capacity shall be offices in a single service to be known as the National Public Service; and accordingly all persons who immediately before that day are members of the public service of the Federation or of the public service of a Region shall on that day become members of the National Public Service:


5.1. Power to appoint persons to hold or act in the office of permanent secretary to any department of government of the Republic or any other office of equivalent rank in the National Public Service, and to remove persons so appointed from any such office shall, as from the appointed day, vest in the Supreme Military Council.

2. Before appointing any person by virtue of this section, the Supreme Military Council shall consult the National Public Service Commission.


The minute you are under the authority of the center and all your civil servants report to the center you are no longer an independent regional government. Like I said earlier, it’s like telling your children in future that because the law says local governments are independent so governors did not control and dictate local government chairmen and control the funds in Nigeria between 1999 and 2023. Let’s not go into why this was done, I don’t have energy today. Let’s just say he created the mess that has plagued us for over 60 yrs and the motive we all know was not altruistic. Unfortunately it backfired on not just him and his people but everyone else. The irony that he then became sec gen of aohaneze, fighting for freedom from the enslavement he birthed.
