I have always known that if he does not file his bail application properly nobody will grant him bail.

Nigerian ex-governor denied bail: journalist

A court in the Nigerian city of Kaduna Monday denied bail to the former governor of southern Delta state James Ibori who is on trial for alleged graft amid protests from supporters outside the court, a local reporter said.

"This court cannot grant the defendant's oral application for bail considering his precedent of having jumped bail in London," presiding judge Lawal Shuaibu ruled, a local journalist at the court told AFP on the phone.

Shuaibu ordered that Ibori, accused of corruption and money laundering, be remanded in the central prison in Kaduna, in northern Nigeria, until January 11, 2008 when the court hearing will resume.

Ibori, who was arrested on Wednesday and arraigned in court in Kaduna the following day, faces a 103-count charge filed by Nigeria's anti-graft agency, the Economic and Financial Crimes Commission (EFCC).

The court's refusal to grant him bail caused a stir outside the court where several hundred Ibori supporters who had been bussed in for the occasion staged a protest.

The women supporters stripped naked while the men unzipped their trousers and exposed themselves in protest, the journalist who witnessed the event said.

The nude protesters then tried to gain entry into the court premises. They succeeded in breaking the barricade set up by the police but were held back by armed policemen.

Eight trucks of armed soldiers watched the scene from a distance but there was no incident of violence.

I was one of them oh! cheesy  This man is just going to rot in that northern "Gworo" jail for nothing!  Please, are there no jails in the south?  Who wants to be in detention in the North--Kaduna of all places in Jehovah's name? shocked

You can trust he is going to get the "Fela" treatment and come down with some serious positive HIV status or full blown AIDS by the time those MOPOLs finish with him. He is and avid womanizer anyway, and just like Fela--no one will be surprised if he falls "suddenly ill"!

Kano kaduna,sokoto where ever he is, he will be tried in a Nigerian court on behalf of the Nigerian people with the Nigerian constitution grin

all these lack of jurisdiction argument should be thrown out!! all these crooks are always yapping about lack of jurisdiction.

Former governor of Taraba State, Reverend Jolly Nyame is not a happy man. His unhappiness stems from the fact that after eight years of what he termed "meritorious service" to his people, he is facing charges of corrupt enrichment. He is specifically accused of siphoning public funds to the tune of N1.6 billion. He is currently standing trial before an Abuja High Court. Not only that, Nyame’s disposition as a clergy is in doubt. He has to convince Nigerians that he is a true man of God. Many observers see it as a very big task. It is also giving him a nightmare.

And to worsen the matter, his application to stop his trial in Abuja was turned down last week by Justice Adebukola Banjoko of the Abuja High Court. Nyame had asked the court to stop his trial for lack of jurisdiction since the alleged offence would have been committed in Taraba State, not in the Federal Capital Territory, FCT, Abuja. The former governor argued that the Economic and Financial Crimes Commission, (EFCC), lacked the power to prosecute him over the alleged missing billions, because the money belonged to Taraba State, not the federal Government. When the case came up on July 13, he also argued that no ***prima facie*** case has been established against him and therefore wanted the court to quash the 41 charges preferred against him. He was also of the opinion that his trial should take place in Jalingo, the Taraba State capital, since the alleged crime was committed there. This was not so.

[b]In his ruling on November 20, Banjoko says the Federal Attorney General of the Federation is empowered by law to institute criminal charges against anyone at any court in the country. "It is not the duty of the accused person to determine where he would be tried. Facts before the Court clearly revealed that offences have been committed and statements of witnesses linked the accused to the offences.

The claim that the money belongs to Taraba State Government, and not the Federal Government is baseless. The issue of ownership does not arise now, the claim that the Federal Government’s rights have not been breached is also baseless", Banjoko ruled. On Nyame’s argument that the charge against him was defective due to the absence of proof of evidence, Banjoko observed that ‘the bundle of evidence before the court, the statement of the accused person, statements of witnesses, photocopies of cheques are enough proof of evidence’. Banjoko said the court had jurisdiction to try the former governor.[/b]

Public affairs analysts believe that Nyame jeopardised his case when he promised the EFCC that he was ready to refund all the money he illegally acquired while in office. Counsel to the EFCC, Rotimi Jacob said the commission was determined to recover all the looted funds traced to the former governor. "Steps are being taken to make Nyame return money he allegedly stole while in office. The move is necessitated by Nyame’s promise in his statement to the commission to refund every kobo he illegally acquired. Part of the alleged offence was committed in Abuja, which gave the court the power to try him", he explained.

Apparently faced with the reality of the case, Nyame’s counsel, Emmanuel Toro last week applied to withdraw his earlier objection to his being tried in Abuja to enable him file fresh motion. But the question on the lips of Nigerians is: will Nyame ever wriggle out of the problem with his integrity intact?

Born on December 25, 1955 at Zing community in the present day Taraba State, Nyame schooled at the Theological College of Northern Nigeria, Bukuru, Jos. He was also educated at the University of Jos, Plateau State. He was governor of Taraba State between 1992 and 1993 during the botched third republic. In 1998, he was elected a Senator, but was not sworn in following the sudden death of General Sani Abacha. He became governor between 1999 and 2007.

each case is different on their merit.

question: was part of IBORI corruption committed in Abuja or outside delta-state?

Also only the world of 'Supreme court' is final and not ' Abuja High Court'.

It would be nice to know what 'supreme court' has to say about this.

Note: I do not support corruption but consistent application of rule of law and justice.

It is interesting how you ignored the Judges verdict and preferred to comment on the opinion of a public affairs analyst.

Note: I do not support corruption but consistent application of rule of law and justice

If that means anything anything to you you will not place priority on the opinion of public affairs analyst over that of a high court Judge.

The man was shipped to Kaduna to make things a lot difficult for him.
In Lagos, most politicians have connections, therefore they will still get VIP treatment from the guards; same thing goes in Abuja. And futhermore, retaining Ibori in Delta state will absolutely be a mistake. This will be home sweet home; access to things becomes very easy.

In Kaduna, nobody gives a fk. The guards will torture his as s as they desire. VIP means nothing in Kaduna; in just few days in Kaduna Ibori will start singing holy song.
In-short, this is done to systematically drain him mentally.

As long as Ibori is not shipped to Togo, I think we should just chill and allow the Fed to do their job.

I am really happy to what is happening to these ex-governor, especially Ibori. Let him get the punishment that he deserve. I am happy that he is not in Delta jail hence he would have been bailed. smiley

If the constitution allows bail, then he must get the bail; or else the Fed will be making another pricey mistake.

We must punished the corrupt governors, but we must also follow the rule of law.

What are we getting at here? A bail application was brought before a Federal Judge and the judge
refused on account of the accused past pattern of behavior, how is the Fed (I suppose you mean
The EFCC) making a mistake here?

Is the EFCC responsible for a judge's rulings nowadays? While I believe Ibori will be and deserved
to be treated well (will probably get the first class cell or private quarters at the Kaduna jail), my last
concern is the welfare of his types.

Pattern of the accused?

Two former convictions in the UK, attempts by Ibori to obfuscate and interfere in EFCC investigations using his cronies in the Delta State Government House, reluctance to honour EFCC invitations.

And just in case you don't know, most courts in the world will grant bail if the
court does not hold the belief that the accused stands the risk of absconding.

I am a member of the Delta Boys Club! - as a matter of fact, Ibori and I are from
the same ethnic group and in Delta we try to take care of business. We need to
make example with Ibori that our governors are not elected to loot but to serve
the state.
