A new twist has crept into Adamawa State
governorship seat tussle as fresh facts have
revealed that the newly-installed governor,
James Bala Ngilari, actually sent a resignation
letter as deputy governor to his predecessor,
Vice-Admiral Murtala Nyako, which the latter
accepted.
Documents exclusively obtained by Sunday
Tribune showed that Ngilari sent separate
resignation letters to both Nyako and the
speaker of the state House of Assembly, Ahmed
Umaru Fintiri, the same day.
In the two separate letters, written on 15 July,
the speaker was copied the one to Nyako, while
Nyako was also copied that sent to the speaker.
To show his acceptance of Ngilari’s resignation
as his deputy, Nyako had on the same day,
nominated a replacement for him as deputy
governor. The nominated replacement was
Honourable Adamu Kamale.
Nyako’s letter to the speaker with ref.
SHA/5/528/Vol. V, dated 15 July, with the
heading “REPLACEMENT OF A DEPUTY
GOVERNOR,” reads: “Dear Speaker, pursuant to
Section 191 (3) of the Constitution of the Federal
Republic of Nigeria (as amended) and the powers
vested in me as Governor of Adamawa State, I
hereby nominate Honourable Adamu Kamale as
my deputy governor to replace Honourable Bala
Ngilari who resigned this morning. Please accept
the assurances of my highest regards and
esteem.”
The letter was personally signed by Nyako.
Nyako was reportedly impeached after the
nomination letter was received by the Assembly.
The documents showed that Mr Francis G.
Richard, the Clerk to the Assembly, received
Nyako’s letter.
The documents were also placed before Justice
Adeniyi Ademola of the Federal High Court,
Abuja who ruled that Ngilari’s resignation letter
should have been to Nyako and not the state
Assembly.
In his judgment, he held that the onus was on
Fintiri as the acting governor to provide evidence
of Nyako’s acceptance of Ngilari’s resignation to
his former boss, as a proof that Ngilari resigned
constitutionally.
Fintiri had appealed the judgment.
In Ngilari’s resignation letter to Nyako, obtained
by Sunday Tribune, he said he was opting out on
personal grounds.
It reads: “Pursuant to Section 306 (5) of the
1999 Constitution of the Federal Republic of
Nigeria (as amended), I kindly notify you of my
resignation from the office of the deputy
governor of Adamawa State forthwith on
personal grounds. I want to thank you
immensely for the opportunity to serve
Adamawa State and wish you and the good
people of the state well in the remaining period
of your administration.”
While copying the speaker the letter to Nyako,
Ngilari wrote, “above for your information and
necessary action”.
The content of Ngilari’s resignation letter to the
speaker was same as the one to Nyako.

Story for the gods. No campaign after election. Nyako and APC should find another story because Appeal Court won't buy this cheap machination.
