Hello all !
I hope all of u r fi9,
I recently applied for UK Student VISA and it got refused undecided , within 3 days frm the refusal date i have already posted the appeal form w/supporting documents with it.

The reasons mentioned in the refusal notice were:
1) I have not satisfied the VISA Officer that i know well about my Diploma Course.
2) My father don't have enough money to support me while studying.

The thing is, i had never experienced such interview b4 and i was a bit nervous n confused while giving the interview.

About the fathers money thing, the VISA Officer did not go through my documents thoroughly, I was having acceptance letter of MCBT (Marlborough College of Business and Technology) with full fees paid 3,000.00 British Pounds, beside that my father was having more than enough amount in bank to support me in accommodation and my maintenance thought out the Diploma course, which is 1 year (OTHM - The Organization for Tourism and Hospitality Management) Diploma Course actually.

Please, can any 1 tell me if my appeal will be accepted?

before i give you any advice or suggestions, please answer the follwing questions,

1. do you have a first degree or any other education qualification apart from your SSCE? if yes, what course did you study for your first degree?
2. what is the relevance of the intended course you want to study at UK to the educational qualification that you have presently?

Hello,
I paid 6500 pounds as deposit and was still denied,
the course was superb relevant to the oil and gas industry,
i was told to forward all documents before the 28 of feb,
i want to know how soon can i get my visa.

Most of the new posters give very scanty details
and I just can't be bothered to start requesting
for further info from them.

In any case if they took the time to trawl through
the various threads and responses on UK visas they would probably
find the answer/s to any query they have.

1. I make this witness statement to counter the fraud that has been instigated against my character and exonerate myself.
2. I applied to study ( Msc subject) at …, in (date , after completing my first degree in (subject). I was successfully issued with an enrolment letter to commence my further course of study in (date).    
3. On (date of  visa denial), my application for a student’s visa was turned down by the ECO on the basis that ,  
4. I was also blatantly accused of fraudulent misconduct by the ECO.
5. I attach herewith marked as exhibit “AK1”, “AK2” and “AK3”, (INFO FROM ?) (as in AIN KAY 1) to substantiate the fact that at no time did I submit any forged document as alleged.  
6. I also attach herewith marked as exhibit “AK4”, AK5”, … (further documentation from ) to further corroborate my not guilty standpoint.

One year Diploma!!! PHEW!!! Thank God "intention to leave"  did not rear its ugly head in the ECO's decision.

Regarding "ability to meet the cost of the course/maintenance and accommodation", you could either choose to be sarcastic and tell them a non-negotiable part of their job specification is the ability to pay attention to detail and tell them to "take more than a cursory glance" at the financial documents supplied by your father (sloppiness and official error) OR let it pass and include the same details again in your appeal submission and witness statement, so that it would appear thrice in the appeal bundle prepared by the ECO if they are stupid enough to let it go to the tribunal.

Re: ability/intention to study, include as much paperwork as you can regarding your ability to undertake this course, and information regarding all the research you took before you decided to settle for this course. 

Though it was not mentioned, it might also help to include why you could not undertake to do this course in Nigeria PLUS proof of what you are going back to do in Nigeria after the course ends bacause some Judges usually get angry with ECO's for refusing on flimsy grounds whilst other substantial grounds to turn down applicants are applicable.

With a degree "intention to leave after your course of study" no longer comes up because one is legally allowed to work for a year and your employer might decide to retain you afterwards.

Researches have always shown that oral hearing is more favourable by a 20%-30% margin, but there is nothing God cannot do. With prayer and supplication make your request known to HIM.

i will give you the lowdown, i actually applied for a visa in Aug and was turned down for about 7 reasons, asking why i was just interested in a masters degree after graduating 2 years ago, stating that i didnt provide my own statement of account, asking how i was going to be relevant in the oil and gas industry, why i was been sponsored by my parents company, that they weren't satisfied that the company was willing to invest its profit in my education, even after i had paid a sum of 6500 pounds. i immediately reapplied and addressed all the issues raised and was again turned down this time the ECO just told a lie by saying the name of the account and the sponsor was different. i have appealled but i am still worried, i want to know considering the fact that i was told to forward all documents before 27 of feb how soon can i expect a decision(not an oral hearing), i just want to know how soon. in case i have to make alternative plans

The listing of an appeal for a hearing is down to the administrative section of the AIT. You will need to
contact them direct to see if your matter has been given a hearing date. Given the deadline for the submission
of your appeal was 27/02/07 I don't think it will be anytime soon,

As for the decision in your case that is entirely up to the speed of the judge. If it is a straightforward case
he/she may give a decision on the same day, alternatively he may give it up to a few weeks later.
All told it may be several months before your case is done and dusted, so it may be a good idea to
have a plan B.

Exactly too Akolawole. I have had cause to meet some peeps who never knew I am on nairaland, saying they can get the free Immigration advice if they are in a fix after collecting money from innocent Nigerians.

Anyways for those with genuine questions and enquiries, I will still continue to give a response to them.

Sincerely appeal cases are 50/50 thing. Just be hopeful and if all issues raised in your refusal letter have been addressed in your appeal statement. Then just be expectant for a good reply.

Let me give you the gist a bit lelele, this Visa agents collect money from honest Nigerians in the name of been a visa agent with Vast experience, yet they know nothig, and they come here to pose questions seeking for answers yet they pretend to their customers that they are highly knowlegeable.

I want to do the OTHM Diploma (The organization in Tourism And Hospitality Managment) from the MCBT so i can start my Tourism business in my homecountry

yea i did mention age, as an ECO if a 26yr old applies for a college programme how would you treat/see the application. same point should be used to access a graduate applying for a college diploma, sounds dodgy innit? I leave you to it.

It has no bearing at all.

UK immigration rules has nothing against age.

Student visa's have nothing to do with age but rather with the relevance of the course to the applicant and the financial ability to pursue the course without having to rely on UK public funds or work. I have seen lots of Police Officers and Civil Servants in their 40's coming for first degree courses. Also, last October the Age Discrimination legislation came into effect so it would be wrong to prevent a qualified applicant from pursuing a course because of his age.

ECO Checklist for Student Visa
Valid passport,Current educational qualification,Relevance of course,Sponsor details,Acceptable Financial outlay to meet the cost of the course ,accommodation and maintenance in UK,Acceptance by UK School approved by Dfes ,Proof that student would return to country of origin at the end of studies,

wont argue about this age thingy, meant a guy some couple of years ago and the reason he was refused was because he applied for a college diploma @ 25yrs and that the diploma can be obtained at a cheaper price in Nigeria, saw the letter me self, so wont argue any further. U said lots of civil servants and police officers in their 40's coming for 1st degree courses, very true cos they already have a career and the programme will be very beneficial to them. Mind you said they came for degree courses and not college diploma!
Akolawole and LondonCool, how can they prove that a student will return to his/her country of origin upon completion of their studies. Dont you guys think it's a bit vague and ambigous?
PS: Not tryin to discourage anyone o, cos anything can happen. This thread is just meant to share ideas.

I was only quoting the UK Immigration rules. It is for he applicant to prove that he will come back to Nigeria.

Did you always believe in what these ECO says?
I am a product of Appeal though many years ago when British High commision was NOT in Eleke but in one building called Chellaram building in Marina[ I WILL SHARE MY STORY ONE DAY].

Just few days ago, one of my people was refused. She was stupidly considered on a completely different rule to the one she applied upon. I have filed the appeal and will definitely win the appeal.

With my experience in few UK courts, intention cannot be proved.
