Our Chinese buyer currently is ready to purchase BLCO on basis ex ONSHORE (not offshore) tank farm in China only with the following procedure:

1. The Seller issues SPA. The Buyer executes, seals and returns SPA. Both parties lodge the SPA in their respective banks. The electronic copy is legally binding and enforceable.
2. Seller sends to buyer copies of ATS from Bulk Allocation, TSR and Discharge Certificate.
3. Upon verification of above mentioned documents, Buyer issues (operative) MT700 to seller’s bank account.
5. Seller sends DTA for buyer to conduct dip test analysis on the onshore tank farm.
5. Upon successful completion of dip test analysis / Q&Q inspection by CIQ, Seller raises final Commercial Invoice (CI) and NNPC issues Warranty of Title (WOT) and all other Onshore Tank Farm documents and Credit documents (documents for payment) on Buyer’s name to the value of the product.
6. After the Buyer receives all the documents specified in the above clause Buyer within 5 banking days makes final payment by T/T or MT103 to the NNPC nominated bank account for the product and simultaneously for commissions for all intermediaries listed in the SPA or as agreed in separate NCNDA/IMFPA.
7. Buyer evacuates product from the onshore tank farm.

The net discount to buyer would have to be minimum US$5.00/bbl to be competitive on the China market. Gross discount can be US$8.00/bbl or higher.

Quantity: 1st and 2nd month each 2 mbbls, 3rd and 4th month each 4 mbbls, 5th to 12th month each 6 mbbls.

MT760 and MT799 aren’t acceptable to my buyer!

Also please note that the beneficiary of the final payment by MT103 from Buyer must be identical with the holder of the original Proof of Product Documentation Package (Seller’s Closing Package) which includes the Ownership Certificate, the TSR (Tank Storage Receipt), the TSA (Tank Storage Agreement) and DTA (Dip Test Authority). If those documents are owned by a different party or different parties, the Seller needs to provide some Certificate of Authority to Sell issued by the owner (or owners) of the documents. Otherwise the Buyer would have to refuse the execution of the payment via SWIFT MT103 to Seller.
