Court sentences fake spiritualist over fraud
Posted To The Web: Monday, November 16, 2009 - Nan

An Ikeja High Court yesterday sentenced a fake spiritualist, Olayiwola Jamiu, 27, to three years imprisonment for defrauding one Inalegwu Aboje of N7,500 under false pretence.

Jamiu pleaded guilty to the two-count charge of fraud and falsely claiming to be a spiritualist in the Synagogue Church of All Nations. The convict, who is to serve his terms without an option of a fine, is also to return the N7, 500 he collected from his victim. The sentence will however run from Sept. 5, when he was remanded in the EFCC custody. The EFCC had taken Jamiu before the court for defrauding Aboje while pretending to be a spiritualist from the Synagogue Church of All Nations.

The Prosecutor, Mr Anselem Ozioko, said Jamiu with one Dauda Latonia, now at large, on Aug. 8, in Ikeja, collected the money from Aboje on the pretence that it was payment for anointing water. The defence counsel, Mr Olufemi Ajayi, pleaded with the court to temper justice with mercy and consider the amount involved as well as the age of the accused. He said that Jamiu demonstrated very deep remorse while in the custody of the EFCC and had pledged that he would never engage in such anti-social and criminal behaviour. The prosecutor acknowledged that Jamiu was a first time offender without any previous criminal record.

He subsequently asked for three months conviction subject to the decision of the court, which the judge acceded to. In her judgment, Justice Morenike Obadina, said that she was satisfied that the accused person understood the charges against him and voluntarily entered into plea bargain with the EFCC. Obadina acceded to the three months sentence proposed by the prosecutor.

“I, therefore, accept his guilty plea and sentenced him as charged,’’ she said. She explained that the light sentence was because of the plea for clemency from the defence counsel, who took an undertaking to monitor the convict. The judge said that due to respect he had for the defence counsel, the sentence would run from Sept. 5, when Jamiu was remanded in EFCC custody. (NAN)
