In such a case, the child becomes Nigerian only. However the article didn't specify the final airspace when the delivery happened. This is important because most of north American countries practice citizenship by birth. So if at the time of delivery the airplane was in another territory outside Greenland, it would most likely be one of the Caribbean countries in which case that country's citizenship would pass on to the newborn

From Paris to New York, l didn't see any desperation to obtain green card as par your reasoning.

Why did she wait till almost delivery time before travelling. Some people are careless about everything. Will the baby be recognize as US citizen as she did not enter Trump's country before delivery?

That lady must have lied in her EDD disclosure if not no commercial airline would have been able to fly her in that condition and even some airlines could have sued her for negligence,emotional distress and safety issues.
About the issue of citizenship,the child automatically attain the citizenship of his parents,in this case the mother was traveling on a Nigeria passport which makes the child a nigeria citizen except she also has a dual nationality.the idea of which country own the aircraft or which airspace the child was born don't matter here as the child would be referred to as foreign born.
So the child is a Nigerian!!!!.

Yes,her intention was to have the delivery in the US but she decided to wait till that late so as to save some medical costs before delivery.smartness gone wrong.

On a more serious note, all of you guys saying the mom wanted the baby to be an automatic US citizen may not be entirely right, recall she is 41years and most women once they have crossed 40 years are a bit apprehensive about child bearing as they are more likely to have complications at that age,hence most of them I know opted to have their babies in the US (especially) and other European countries just so they can get the best of medical care.

Google about Theory of Extraterritoriality in international Relation. I think the Child will be a citizen of the country that the Airline is registered in and it will be citizenship by Birth. Be guided by the doctrine that if a US or UK embassy in Nigeria or a ship or airline registered in any of these countries is attacked it is regarded as an attack on US or UK direct. In the same line a Child born in US embassy in Nigeria will be treated as a US Citizen and is in fact a US citizen. Sorry for the long story just attempting to make the picture clearer.

Which medics??..did they have the legal permission to do what they did??.
Which airspace??...where did you read from the article the airplane was in US territory??
What of the plane was over the Pacific or Atlantic Ocean which in some cases is an international waters,would the child now become a global citizen ?

This is correct. According to US laws, the baby will NOT be a US citizen, since that aircraft was not over US airspace. I believe it was over Canadian airspace though. Otherwise, the baby takes on the citizenship of it's parent.

No! it's usually the country the plane is registered in but in such cases like this, The US usually claim the child as long as it involves them being that the flight was headed their way. So automatically, The child is half Nigerian,half American.
