Good day guys.

Please i need advise from pension experts. I was working with a private contract-based firm until March 2019 when the company became redundant (the company went out of business as it's sole contract with a client firm was terminated). Now the issue is that my former company deducted about 10 months pension contributions from our salaries but failed to remit it to our PFAs. Before the redundancy, we asked severally about the deductions and they promised to pay. Out of fear of job loss, i and my colleagues didn't write pencom.

Now, the company is out of business, and our pension deductions were not paid as they promised. I s there something that Pencom can still do to make them pay? Or should we forget the money? It's painful how employers are exploiting employees at any given chance because there are little jobs out there.

Funny enough, the owners of the company secured another contract with another client firm in a different region of the country and registered a new company to undertake the operations of the new contract. Isn't that corporate yahoo yahoo?

Can something still be done to get our money?

It happened to me.But after I left I forced my former employer to remit the deductions they made from my monthly salaries to my pension account.Na gragra I do o.Because them no want government wahala.

It happened to me also but after I left I sent them email and copied my lawyer friend grin grin. grin

The Executive Director was scared because she didn't know if it was Afe Babalola's boy I copied. Immediately, she started a sweet conversation, someone that didn't pick my call or respond to my messages. In a nutshell, they paid my money in full 1m+

But in your case, the company is broke sad

Write pencom still.

This is a clear case of pension fraud and your employers may be serial offenders here.

Nothing stops them from registering a new company and doing this to new employees.

Also, where were the deducted funds warehoused after being removed from your salaries? Were they used to run the company as against being remitted to the PFA? That's misappropriation

It’s simple. Write to PENCOM, attaching proof your your indebtedness and particulars of your former employer. It’s very easy to trace them and even if your employers incorporate a new company, he would be traced (moreso when he’s a director/shareholder in the new company).

Nevertheless, if you still have means of contact, please do inform them about it and threaten to report to govt agencies.

From your narration the company has gone under so everything went under with it.

The law stipulated that pension deductions MUST be done one week after salary payments and it becomes an offence if company refuse to comply.

The mistake you did was not to have written PENCOM, you should have done that.

Your claim that the company came back under a new name can still not help your case.

But IF in the near future the company comes back to life you can ask for your pension deductions , but for record sake and just in case the company comes back to life, make an official report to PENCOM and keep a copy of your petition while looking for something else to do.

In the real sense it is not your fault because the so called PFAs were suppose to ask for contribution once they don't receive it from the companies. But for the usual Nigeria problems, they sit in their phony offices expecting everything to be on auto pilot.

The PFAs too are part of the problems.

Finally i pray you get something good to engage you, just take it as a bad debt.

I was in paid employment for 10 years before resigning and starting my own Organization.

I was owed pension for about 10 years as well, but I wrote to the organization and quoted sanctions applicable under the Pencom reform act 2004/2014, they immediately paid to avoid escalation in April, 2019
