Appeal Court Upholds Sanwo-olu’s Election by Lagosfinder(m): 9:24am On Nov 10, 2019
The Court of Appeal in Lagos on Saturday dismissed an appeal filed by the Labour Party challenging the judgment of the Governorship Election Petition Tribunal which affirmed the election of Mr Babajide Sanwo-Olu as the Governor of Lagos State.

According to a statement by the governor’s Chief Press Secretary, Mr Gboyega Akosile, the appeal court, in a unanimous decision, held that the appeal lodged by Labour Party lacked merit.

Recall that the Labour Party and its governorship candidate, Mr Ifagbemi Awamaridi, had appealed the judgment of Election Petition Tribunal delivered on September 23, 2019, insisting that Governor Sanwo-Olu was not qualified to contest the election held in March 2019 and that the governor did not win the election.

Respondents were the Independent National Electoral Commission, Sanwo-Olu, All Progressives Congress, INEC Residential Electoral Commissioner, the Returning Officer for the Lagos State Governorship Election, the State’s Commissioner of Police and the Nigerian Army.


Justice Hannatu Sankey, who read the lead judgement of the five-man panel of Justices of Appeal Court, specifically affirmed the decisions reached by the tribunal.

According to the Court, the appellant (Labour Party) failed to produce any oral or documentary evidence through witnesses and other channels to establish the fact that Governor Sanwo-Olu was not qualified to contest the election and did not win the governorship election.

The Court further ruled that the petitioner went on a “Columbian Journey of making assertions with nothing to back it up,” and thereby dismissed the appeal in its entirety.


The Appellate Court also upheld the Tribunal’s decision that no proof of allegation of collusion and assault against officers of the Nigerian Army was provided by the appellants, adding that no sufficient fact was provided to substantiate allegation of electoral malpractices at the polling units against the respondents.

“The appeal is lacking in merit and is hereby dismissed. I hereby uphold the judgment of the Lagos State Election Petition Tribunal,” Justice Sankey held.

All the other four Justices of the Court affirmed and concurred with the lead judgement.

I don't even know that someone was contesting that. People will just make enough money to the extent that they will map out a huge sum to waste.

Otherwise, how could anyone have challenged that election if not for the fact that he wants to waste money in court. But I am happy the judge rightly stated that the petitioner was on a Columbian journey.

If it was PDP that challenged the election and lost this appeal now, I would have helped them say "Democracy is in danger", "Judiciary has been intimidated to submission", "the Appeal panel have done the bidding of Tinubu who handpicked them; Nigeria is in trouble!"

you are very correct, the judiciary in Nigeria has failed in their duties
Unlike in other climes where they are a stabilizing factor,just like elders will do in every society
The current judiciary has by their conduct has unwittingly set the country on fire,which when it starts will also consume them
That which they are running for,that makes them them give judgments instead of justice will still catch up with them
Because by 2023 politics would have come down to do or die,win at all cost and let your opponents go to court
But nobody will want to go to court because it will be a worthless exercise,so everybody will slog it out at the election putting in everything both fair and foul , just make sure you are declared the winner,such options may include okorocha and ifeanyi uba methods
Whatever options it doesn't look good dude to the failure of the judiciary

just like yahaya Bello that violates the electoral act by registering as a voter twice,this sanwolu voted while not being a valid voter , which is an electoral offence and also a valid ground for disqualification and how judiciary under the incorruptible current administration over looked it.
Whatever gains that have been made in the past has been reversed by this inept government of buhari,all institutions has been compromised,no country advance without strong institutions
