They use the money to settle more than half of the Nigerian population during electioneering or bribe their way to continual stay in office.
Then recoup it again through means like this.
This is how our Nigeria rolls. Not gonna stop any time soon.

Neither do they know what is a Garnishee order absolute.

In simple terms- Garnishee order arises when a court instructs a third party (the bank) to pay a creditor a certain sum on behalf of the debtor. In this case, CBN is to pay a team of lawyers on behalf of FG (debtor).

GTB has a similar case with Innoson.

Failure to do so will attract consequences.

What I don't understand is why Emefiele would go to jail. What happened to entity concept?

Emefiele is different from CBN. It is just like Segun Agbaje going to jail for failure to pay Innoson a sum.

Abi, somebody epp me out.
u shouldn't be explaining legal terms to people who do not pay consultation fees nor have it as a field of expertise, this you do is very unethical

I am not bound by such ethics Sir (i.e) I am not a lawyer.

You try small

The “ Corporate Entity” concept has exceptions, in such cases the “ Corporate veil” is lifted. It is done for a number reasons one of such is to prevent individuals from using corporate entities to perpetuate illegalities

Thanks a lot, Tee. Maybe when I have strength to put something into my empty head, I'll read more on this.

Thieves everywhere. Besides, is it his personal money he will use to pay? Was the refund made to his personal account? Those who benefited from the refund should pay the lawyers. But that amount is ridiculous. Did the government have lawyers that works for them? Too many questions begging for answers.

You're right cause CBN is a biz entity, and I'm sure such action by CBN was taken after a board resolution. so it's gonna be FG vs CBN not Emefiele. They just wanna indict or bully him. Worst to happen is that CBN is gonna pay an additional fine

There is a concept of lifting the 'Vail of incorporation' where the court go after the principal actors of the entity (usually the MD or Board of Directors).

If the entity concept held as you said, then Enron's executives would never have gone to jail following the cooking of their accounting books.

I think Emefiele is the one with the power to approve the payment to the lawyers which he hasn't done or has probably blocked. The entity concept holds in certain circumstances but definitely not this one.

For ignoring court summons, we published two videos that discussed the power of a court to summon/the power of criminal summon

https://www.youtube.com/watch?v=ERY1bIOLM1c

Under Nigerian Law, you can either be served a criminal summons, meaning that you are the accused, the CBN Governor is the accused, or a witness summons, which means you know something about the offence, come and tell the court, this happened to President Goodluck Jonathan in 2013.

Our other video tells you everything about criminal summons in plain language

https://www.youtube.com/watch?v=6eDAkc8I6U4

Interestingly, it was published a few moments ago
