Edo State Governor , Godwin Obaseki, has described an interim injunction restraining him from contesting the primary of the Peoples Democratic Party , as an attempt by fifth columnists to destabilise the party.
Obaseki who spoke through his Media Adviser, Crusoe Osagie , in a telephone interview, on Tuesday , noted that opponents of the PDP were already jittery about the overwhelming support the party was receiving from the people.
He said , “ The court order was obtained last night . Our opponents outside the party are trying to use fifth columnists within us to replicate the chaos in their party.

“ They are worried about the popularity and acceptance of the PDP and our amiable Governor so much so that they have become desperate in their quest to stop a contest they know they will lose. ”
The ruling All Progressives Congress is embroiled in a leadership tussle following the decision of the Appeal Court to uphold the suspension of the party’ s National Chairman , Adams Oshimohole.
Osagie maintained that as a law -abiding citizen, Obaseki was going to court to seek the vacation of the restraining order .
The governor appealed to the people of the state , his supporters , and members of the PDP, to remain calm and law -abiding .
Obaseki expressed confidence that he will get justice as his legal team present facts of the matter before the court.

UPDATE: After careful perusal of the court papers, I have discovered that the court is yet to restrain Gov Obaseki from participating from the PDP Primaries. The prayers of the applicant on page 1 are different from the Orders of Court granted on page 2.

This is a motion ex parte that was granted pending the determination for the motion on notice to be heard tomorrow.Court cannot stop a person from contesting a primary. Supreme court has affirmed this.

The order of the court remains only to grant accelerated hearing and substituted serving of the court process on Obaseki and others.

The court did not stop Obaseki from participating in the primaries of his new party.

Their will be an hearing on the 24th,where the party(PDP) can ask the order be vacated as plaintiff can't dictate to his party's NWC. As no court can adjudicate on that.

Hi counsel, the court granted prayers one of the Applicant and this was evidenced in Interim Order1. The 8th Respondent was duly restrained by a court of competent jurisdiction from participating in the 7th Respondent's primary election.

While I do not subscribe to the 8th decision to defer a subsisting court order, I must confess that there is little or nothing the court can do in this regard as the 8th Respondent is yet to vacate office and thus enjoys immunity from any contempt proceedings. See IMB Securities Limited v. Tinubu. It was also reported in Prof. Itse Sagay's constitutional law book.

Let's keep our fingers crossed and see how it pans out because the sole issues for determination at the end of the day will be "whether or not the decision of the 7th Respondent to admit the 8th Respondent and waivers incidental thereto, prejudiced the Applicant in any way whatsoever as to infringe on his rights as a party member?"

I align myself with your erudite submission on the possibility of the summons not succeeding.

Perhaps the applicant just wants to make noise as to attract the attention of the 8th Respondent for a possible quid pro quo arrangements. grin

APC CRISIS UPDATE

6 New cases of APC crisis were confirmed on 22nd of June, 2020.

BREAKDOWN:

3 in Rivers State
1 in Edo State
1 in Abuja
1 in Ondo State

Details in Rivers State (3):

* Acting Chairman of APC in Rivers State, Igo Aguma suspended the National acting Chairman, Victor Giadom.

* Then party members in the state loyal to the suspended Acting National Chairman, suspended the State Acting Chairman.

* Two groups belonging to Rivers APC party leader opposed themselves. One group said they will burn down Rivers State, the other group said the group that said they'll burn down Rivers State are stupid ethnic irredentists.

Details in Edo State (1):

* The National Acting Chairman of the party said there is no primary election authorised by the party in Edo State, wrote INEC. But the primary election has been conducted. That's 1 new case in Edo.

Details in Ondo State (1):

* The Deputy Governor of Ondo State & Ondo State' SSG said they're no longer doing again, returned their brooms. They resigned their membership of APC and decamped to PDP.

Details in Abuja (1):

* Hon. Worgu Boms was sworn in as the New National Deputy Secretary to replace the acting National Chairman suspended by the Rivers State Acting Chairman of the party.

There are suspected cases in Ekiti and Benue States, tests are currently being carried out to confirm their status.

Please you're advised to observe political distancing from APC as there is no cure for the crisis rocking the party in sight.

I am very happy to find out that there are still scrupulous people like you. I have been startled by the spreading news that court restrained Obaseki, when it was just the prayers of the applicant to restrain Obaseki that was posted, and people began to mistake it for court orders. I am not particularly supporting Obaseki and neither am I opposed to him, but it bothers me that in Nigeria, media outlets could spread an applicant's prayers as a court order. It also shows that lots of people here don't read before commenting.
