If he refuses to honour the court...be sure to see the guy in jail.

You should have stated he could be imprisoned for contempt of court. HE CAN NEVER BE IMPRISONED FOR OWING A LOAN APP MONEY. NEVER.

Creditors can sue you for an unpaid debt in civil court and that is it.

Court could even ask a defaulter to pay N10 every month till the loan is fully paid.

I would explore better means of debt recovery like GSI and others than go to court.

Where is the scam? Are you trying to say that when you gan gan took out the loan you scammed the company?

If you do not have the means of repayment, do not take a loan. The company simply forwarded the details of the borrower to their debt collectors. That’s the procedure. The debt collectors took the necessary steps:
1. Send the reminder to the borrower
2. Give the borrower some more time to pay up.
3. Get their lawyer to send the demand notice
4. Go to court to get their money.

The borrower either did not have the money to pay while these processes were going on, or he simply ignored them. Now the bobo dey run helter skelter. Na who una want to blame?
Naija people think say them wise.
That fellow will have to pay a lawyer to defend him if not the loan company will get judgement. By the time they grab all his property, garnishee his accounts any where in the country through his bvn, his eyes will clear.
His best bet is to approach the loan company, give them their money, pay the interest and their cost so far of litigation.

The court order is as useless as Naira right now. When it comes to loan default, there's not much the lender can do. Las Las he will be paying ₦100 Every month.

I am not supporting defaulters of loan. I am simply saying that they should be regulated.
Have you been embarrassed before by loan apps? Like nor be you borrow money o. But they keep calling you to call someone to pay up. Who does that?

One loan app still dashed me 28k yesterday, I nor ask oo they just sent me message say I get good credit I don use am chop pepper soup. I dey wait for their court order.

Court "Order" or court summons?

Interlocutory orders are not given in vacuum.


You can not obtain an order of the court without first activating the jurisdiction of the same court by way of filing your summons (in a civil suit) or a charge (in a criminal trial).

Those money lending apps are licenced by the same court where he is being charged,so be careful not to preempt the court.

Zenith bank the other day told me flat out, they have disabled quick cash on their app because Nigerians do not pay and the stress of chasing them is not worth it.
Anyway, as per this court case, it will be a magistrate court or Lagos state small claims court that will dispense of the matter swiftly.
It might be over 3k to pay 6k as you said, but the company might also demand accumulated interest, cost of litigation, and damages.

Those guys show me pepper in 2020. Them call my mama for village. Them message my pastor and my younger ones sef. They declared me wanted by efcc ontop 21k. I lost my phone on a journey and couldn't get the app to pay back. I was faithful until then because I was trying to build up to a higher loan about. Chai! After I paid them, I can't touch loan apps with a 40 feet pole. They will take your peace of mind away.

But tell your neighbor to go and pay joor.

This is how bad Nigerians spoils market for good Nigerians. I'm not even talking about loans only.

Yes, it is within his rights to countersue, Ofcourse his may have been defamed. But surely the op provided his contacts willingly before the loan was approved. I am sure in the agreement you tick the box signifying consent, you have given parmission for them to contact your contact list on your phone. Who reads the agreement?
As per high interest, I do not see that as an escuse, folks are informed of the interest before hand, you have the option to accept or decline, once it is accepted no more excuses.
3 weeks ago, one of them offered me 30k to pay 7k interest in 1 month. I rejected.
1. The amount was small, 2. The interest rate was high.
Next day they called me to take the money, I said I no want. Thank you. I deleted the app.
Rather, I loaned myself money from my dom acct.

Yeah I totally support your position about these loan sharks over stepping their bounds when they reach out to contacts. I totally hate it but what can we do in this country? We as citizens sef we lack awareness about data privacy. Many people are happy to drop their contacts (email/phone number) anywhere without hesitation. For me the first time they(loan sharks) call me they only get to speak with me for 10 seconds. After that, I block the number for life.
