How are they jokers naa, if na ordinary 3k to pay 6k, why wount the debtor pay?
Zenith bank the other day told me flat out, they have disabled quick cash on their app because Nigerians do not pay and the stress of chasing them is not worth it.
Anyway, as per this court case, it will be a magistrate court or Lagos state small claims court that will dispense of the matter swiftly.
It might be over 3k to pay 6k as you said, but the company might also demand accumulated interest, cost of litigation, and damages.
Ie 6k matter fit turn 600k grin
600k. De play

grin Loan shark wey no get registration or recognize by Nigeria government na him dey serve person court order? Dey play!

Your neighbor should not worry about anything or panic. They can't do shit.

He should pay them only what he collected without single interest.

10k to payback 16k in 7 days, that's worse than robbery. I'd take the loan and pay 10.5k in 2 weeks.

You are advising the young man wrongly. First, the loan app might actually be registered, secondly the court summon might be genuine and asking him to ignore will definitely get him into trouble. Lastly, his best bet is to pay cos if the summon is genuine by the time he hires a lawyer and pay legal fee that will be equivalent to the money he is owing.

Don't easily advice people to disregard some of these things especially when you haven't sighted the subpoena to know it's fake. That might get him into more trouble

You needed cash, and you pleaded for a Loan app to rescue you and your dying family help, and they helped you.
Later you turned your back and betrayed the loan app, you are the worst robber.
Next time you guys need a free loan approach governments agencies or your state governors

Yeah I totally support your position about these loan sharks over stepping their bounds when they reach out to contacts. I totally hate it but what can we do in this country? We as citizens sef we lack awareness about data privacy. Many people are happy to drop their contacts (email/phone number) anywhere without hesitation. For me the first time they(loan sharks) call me they only get to speak with me for 10 seconds. After that, I block the number for life.
it can be crazy. You block today they change number. It's because of them loan app I subscribed to true caller premium. I hate it so much.
I had a friend that borrowed and paid back but these people keep sending messages to me spoiling this person.

most are not license and the federal government is after them, banning so many of them. Any agreement he signed in their terms and condition contrary to the constitution is null and void

What if they are licensed and genuine? some of those loan apps are licensed so before he disregard the summon let him verify and seek legal counselling, in all his best bet is to pay.

Relax when you are a debtor?
“Na so dem dey do”? Na so you sef go take am until dem take court order collect your properties.

Where is the scam? Are you trying to say that when you gan gan took out the loan you scammed the company?

If you do not have the means of repayment, do not take a loan. The company simply forwarded the details of the borrower to their debt collectors. That’s the procedure. The debt collectors took the necessary steps:
1. Send the reminder to the borrower
2. Give the borrower some more time to pay up.
3. Get their lawyer to send the demand notice
4. Go to court to get their money.

The borrower either did not have the money to pay while these processes were going on, or he simply ignored them. Now the bobo dey run helter skelter. Na who una want to blame?
Lolz
Firstly, u work for Them. Go find another work bro
Secondly, the court paper is fake because i have been there
I go send u plenty fake court paper I received via mail from them. After one month again, they will start begging again for me to pay. Them even remove all the interest added and left just the money i took🤣🤣

I really use them catch cruise in 2021/2022 january😋
The last time i heard from dem was April last yr😂

.

First, Let me ask you a question, is debt a civil or criminal offense in Nigeria?

Mr man you are actually the one that needs to go back to school. You didn't read his posit very well and jump with ignorant submission. Yes a civil case can also be criminal in nature. If you had taken time to digest the write up you would have understood he never said failure to pay will lead him to jail and yes If he fails to honour the court summon that can possibly lead to bench warrant and prison term for contempt of court, before you castigate people publicly be sure you know what you are saying and also be sure you understand the person properly

I know right! It does get crazy when you get multiple calls from these loan apps. I'm also not a fan of True Caller (TC) either. The only difference between TC and the loan sharks is that TC doesn’t give out loans. But the way they harvest peoples phone numbers from their subscribers phone address book is, in my opinion, very unethical

Why do Nigerians collect loan with no intention to pay back or pay complete. Some will even justify the non payment with the excuse that they have been paying all this while and just because they have defaulted the past few months shouldn't be an issue.

The other day it was some Uber drivers complaining about how high the monthly rate they have to pay back for the cars they are using. You are supposed to study the market, do your risk analysis to know if the rate given to you is favourable or not and walk away if it's not.

Tell your neighbor to write them a letter of appeal to remove the compounding interests on the loan; stating that he will pay the actual amount he lent and how long it would take him to pay it. He can as well seek help from a lawyer who can offer him a free service (pro bono) to seek for the removal of the interests accumulated on the loan.

He must try not to run away from his creditor. That is dangerous.

Some of the loan app no get license to sue you in court, check the name and search for it if there company is license abeg go pay but if they are not, it's just formality

Yes, it is within his rights to countersue, Ofcourse his may have been defamed. But surely the op provided his contacts willingly before the loan was approved. I am sure in the agreement you tick the box signifying consent, you have given parmission for them to contact your contact list on your phone. Who reads the agreement?
As per high interest, I do not see that as an escuse, folks are informed of the interest before hand, you have the option to accept or decline, once it is accepted no more excuses.
3 weeks ago, one of them offered me 30k to pay 7k interest in 1 month. I rejected.
1. The amount was small, 2. The interest rate was high.
Next day they called me to take the money, I said I no want. Thank you. I deleted the app.
Rather, I loaned myself money from my dom acct.

My brother I have a similar case like that when I see the interest I was like 5500 to pay 10700 I deleted their app immediately but to my surprise the next day I just see their credit alert am waiting for them to serve me court order too......

Who the hell is this quoting me?

The person you are defending for free (At least get paid to do these things grin) never explained clearly that failure to service Debt can never get you in prison unless there is fraudulent activity.

This simple message i just bolded above will be on this forum for years to come and will give info to people that didn't know this. I am happy i will help people for free for years to come.

Rather he kept on going on about Court unleashing venom like the court is out to get you and its a criminal offense.

Nairaland is a PUBLIC FORUM and a lot of people visit this forum to be informed. Don't confuse people when you can clearly explain in few words.

This is how to separate educated people from illiterates.

If it's by email or Whatsapp, then it's fake. It's one of their tactics to cajole their debtors into paying. They will even create fake police documents summoning the debtor to a police station. This is to create fear in the debtor to go and pay.

Those guys show me pepper in 2020. Them call my mama for village. Them message my pastor and my younger ones sef. They declared me wanted by efcc ontop 21k. I lost my phone on a journey and couldn't get the app to pay back. I was faithful until then because I was trying to build up to a higher loan about. Chai! After I paid them, I can't touch loan apps with a 40 feet pole. They will take your peace of mind away.

But tell your neighbor to go and pay joor.

Best thing to do, is to apply from a phone that does not have any of your contacts or better populate the fake with fake contact info.

Note also that, most of them are operating illegally only few have been licensed by the Government making their act illegal and would result in their suit against you in any court thrown out, if you have the presence of mind to challenge their legality.

Signing up for TC automatically means you accept for them to collect all data in your address book. So you are giving the phone number of your family and friends to TC without their knowledge and approval. Same thing the loan apps do

These loan apps are terrible. Yes they give immediate gratification but the terms of payment, especially the short time for payment is not good nor feasible. How can you give someone 30 days to pay back 40k or 60k? The interest too used to be high. Well, na person wey collect must pay back na, if not why you collect?
