Please I need some clarification. Bought a house and my neighbor is claiming that he will destroy the wall if I do not allow him to raise the fence from my side and put pillars as we both own the wall. The wall was built by the man I bought the place from.

If the fence is between your plot and his, then it belongs to two of you. I see things like that all over the place. If he wants to raise the fence on his own, what the heck is wrong with that?

He who owns the land on which the fence is built owns the fence.

This raises a lot of questions concerning ownership via boundary issues and the survey plan. The first question is who built the fence? Was it the previous Seller or your neighbour? If it was your neighbour, then automatically he has the right to raise the fence due to the fact that he owns it first and must conform with the building practice standard of the acceptable size of a fence. Also the fence must not cross beyond what has been allocated by the Survey plan in the building plan building unless you have a very good ground to sue him for trespass. Such a thing is happening to a Nairlander at Ipaja that bought a State Allocation land and the neighbour tried to raise it without the knowledge of the Nairalander and he brought an Action for Trespass and Alausa went there to remove the whole thing to conform.

Also why does he want to put the Pillar numbers there now? If he isn't the owner, he should take permission from you and even if he is the owner, his pillar number and yours will never correlate because i doubt if its the same surveyor that did the survey plan for the 2 lands. If its the previous Seller that sold the land to you that put up the fence, the neighbour has no right to raise the fence unless he obtains your permission unless that is a clear case of trespass.

The best way to solve this thing is to call a surveyor you trust and an Architect to liaise with your neighbour to do things properly so that he does'nt encroach into your land via trespass or be a nuisance and if he continues to violate this through threats, alert the Town planning authorities and he will bring his building plan (That's even if he has any) to show them if he has the right to alter the building plan without their permission. The money he is using to threaten you will finally enter the pockets of Alausa Town planners if that doesnt do it, bring an injunction to restrain him. Shikena!

I really dont see what the fuss is all about.Just make sure the height is not outrageously high,period.If you thought about air supply,remember that a typical fence used to be barbed wires and gardens before the nightboiz made it compulsory to build a brick wall.

The owner of the land owns the fence, if he destroys your fence take him to court and sue for trespass

What is wrong with him raising the fence and putting pillars? doesn't that make your property more secured? how does him building that fence affect you?

Listen, he is your neighbor and you should not allow problems come in between you people because of your children. If he wants to raise the fence, without destroying or encroaching into your land, no problems. Never allow this bring problems between you people because of your children. Handle this with care. You came into this world with nothing and we shall leave this world with nothing.

I had a more serious problems whereby a woman encroached into my own land I bought and exceeded the pillar by 3 feet, She already built on it. I saw it and prayed over it and left her and erected a fence and still gave about 3 feet from the fence. You allow peace to reign. She greets me and respects me. She is an elderly woman and I have peace within me because if I make problems with her now, when I am gone from this world, my children with her children might not handle this amicably and it might result in killing each other.Is not everything you make problems when it concerns land issue. You are right my brother. The best advice is to meet your neighbor and sort out some things. Eventually it will bring mutual respect. This is the problem we are having in our environment now. The children of one house can not go to their neighbors' house because of one boundary dispute or the other that was not handled very well. Now the landlord association is in factions, some people can not work with others and it is affecting the development of the area. Despite the fact that the environment has a good location. Some of us are now planning to leave because there is no love among the neigbours and the children are inheriting the hatred. PLEASE DON'T ALLOW HATRED TO START BETWEEN YOU AND YOUR NEIGHBOR, WE NEED EACH OTHER ONE WAY OR THE OTHER.

in my opinion i think the wall belongs to the two of you.....so if he has good reasons to raise it then i feel you should let him and if you have better reasons to leave it at its normal height then suit yourself.....

If the fence is on your land no problem, tell your neighbour build his fence on his own land.

If he raise this wall will it affect your house , i mean is it going damage something
