The person that erect it owns it except the two of you contributed to erect it. so if you erect then it is yours and there is nothing anybody can do. as for court injunction, i dont think any law court will grant such injunction to pull downs somebody's property or fence. The only way out is for the two of you to settle amicably.

He has refused to consult with me, he said he does not want to have any interactions with me as he regards me as young and would rather his wife deal with my wife. Op, if your fence is on your land then it is yours. If it is on yours and theirs then you both own it irrespecyive of who built it. He may decide to make you bring it down becaise it is partly on his land too. So, go and measure the land and find out where the fence sits.

The real issue is not who owns the wall really as my lawyer finally made me understand but the danger the wall posed to my life and property. The wall was raised so high that if it fell it will take out part of my house and also it prevents circulation of air to some of the rooms leaving them stuffy. The danger and health concerns were the main issue.

Woww after five years...... I understand the OP, the height of the wall was the bone of contention. Looking forward to hear the court's verdict. Most cases this should have been settled out of court. My guess is that the standard fence height will be followed here.
