5 LEGAL WAYS SALARY/WAGE DEDUCTIONS ARE ALLOWED.

Many conversations have revolved round people saying that they don’t know why their organizations deduct from their pay and most times they are unaware of the reasons.

The only way salary deductions is permissible is if among these reasons as any other deductions will be outright stealing from your employees:

1. *In respect of overpayment*

When your employer overpays you as an employee, he has the right to deduct from your subsequent salaries/wages. The recovery must be made within the space of three months from the month the overpayment was made. See S5 (5) of the Nigerian Labour Act as a reference.

2. *In respect of Trade Union Contributions*

Your employer is also allowed legally to deduct from your salary for the purpose of contributing on your behalf to a registered trade union you belong to.
See S17 of the Trade Union Act and Section 5 (3) of the Labour Act as references

3. *In respect of willful misconduct or negligence of an employee*

I have heard many HR Professionals argued that Labour Law was enacted to support employees. I don't think so. It's only a fair, equal and justice oriented law just like all other sources of law.

The law permits the employer to deduct your salary/wages when you as an employee involve in a willful misconduct or negligence that caused losses or injuries to the employer.

However, the employer cannot deduct your salary in this respect until he (employer) has gotten in writing a consent from an authorized labour officer.
See S5 (1) of the Labour Act and read the Minimum Wage Act for further clarifications.

4. *In respect of statutory deductions*

An employer is permitted to make deductions from your salary/wages for certain legal contributions like Pension, NHIS and so on.
See S5 (1&2) of the Labour Act and read up the Pension Reform Act, NHIS Act for further references

5. *In respect to tax deductions*

The employer is also allowed to deduct from your salary/wages a certain percentage (%) from your salary for the purpose of paying taxes on your behalf as an employee/worker.

What percentage should be deducted from your salary depends on the amount you earn monthly/yearly.

Having mentioned the above, all employees/workers should note that the total amount of deductions that may be made from the wages/salaries of a worker in any month shall not exceed one third of the worker's income.

If you start making money and paying bills, you will realize that most of our parents sacrificed a lot for us.

I remember the day I bought my first car, just a few months after joining a company.

It was a moment of immense pride for me, finally owning something representing my independence and adulthood.

But little did I know that car would become a money pit that would drain my earnings and time for the next two years.

Despite my due diligence, the problems surfaced immediately after the car was handed over to me, as if it were cursed.

In what my Nigerian friends would call "jazz," the issues continued until they started affecting my work and personal life.

But I loved that car a lot, maybe too much, as my girlfriend at the time would attest.

I also felt that selling it would be admitting defeat and failing to handle the responsibility. I was stubbornly persistent and determined to fix every problem, no matter the cost.

Looking back, I realise that the line between persistence and stubbornness is thin.

I was so focused on holding onto something that wasn't working that I failed to see the bigger picture. Not until much later did I learn the importance of knowing when to let go.

Life is full of situations where we may be reluctant to give up, whether it is a job, business, or strategy. We pour our passion and efforts into something, and it becomes a part of our identity.

But it may be time to consider letting go when the costs exceed the benefits, or the actions no longer align with our purpose.

It takes courage to admit that something isn't working and to make the tough decision to move on. But sometimes, it's the best thing we can do for ourselves.

I know the passion and efforts that one puts in may cause a reluctance to let go, but if it is not working, it is not working!

I read somewhere that the phrase “Winners don’t quit” should be changed to “Winners know when to quit.”

Who is Your Boss??

We have various bosses but there is one boss who your bosses submit and that's Your Physical body.

Regardless of who you are when your body breaks down, everything about you breaks down, no matter how small that part of your body is, when it breaks down, you will forget your CEO Title or whatever title you have.

We take care of our corporate boss and forget our Body Boss, when the time comes she will tell us who the real boss is.

This brings me to how this my wonderful boss decides to show me shege😭😭😭😭😭

On the 12th of March 2023, I felt a little strange in my body and decided to knock it off, like I always do, slept that night and it became a little worse but I felt it will go away like any other, instead of me to go to the hospital, I carried my coconut head straight to the office, my dear People, the only thing I remembered is how I got to the office but not how I got to the hospital.

God bless my colleagues who acted quickly and took me to a nearby hospital, on checking my vitals, the nurse screamed, her fever is high we need to bring it down quickly, they had to give me an injection to quickly help with the temperature make the baby girl cross to the other side.

The sight of the needle gave me a scare, but the scary part was that it was Nurse Aliza that they assigned to me😭😭😭😭😭😭😭, for my Nigerian people, you know what I mean, she passed it through the wrong vein but hey, I was too weak to fight her, by this time the injection fluid had mixed with blood and my hands were swollen, I was not in my element so no strength to ask questions nor told her to stop when I was fighting to survive. Nurse Aliza wanted to do me but God do her🥺.

My body decided to tell me who the real boss is.

For those of you that take your job more seriously than your health, I hope my current situation can help you realign your behavior, if your body ever shut down you will beg and cry for it, If God decides to show you mercy, you will regain strength but if not........ I rest my case.

Take care of the "Body Boss" so you can be healthy for yourself, your family, and then for Others.

Stop ignoring your health, a simple mistake can cause you a lot.

A dead person does not understand professionalism
A dead person does not respond to emails (I wonder which branch of office you will do that from).

One thing I have realized is that when you are not in the office:
When you are tired rest, rest is not a sign of weakness
Your team will be fine in your absence
Your team will learn to solve problems in their way
The project will go on without you
The clients will adjust to not hearing your voice
The Organisation will close great deals in your absence

And you know what, IT IS OKAY as far as the business objectives are met.

A healthy employee is a productive employee.

INRODUCTION TO PAYROLL MANAGEMENT.

Payroll can be referred to the process of paying employees. "Payroll is referred to the total emoluments paid to an employee in consideration for services rendered to the employer". It is very important for organizations to systemize the quality of their payroll output. This is to enable the team handling the payroll functions avoid errors and other risks that could affect the employee's negatively.

Paying your team requires making the right deductions and allowances. More importantly, payroll and it's related costs must be accounted for appropriately. Statutory deductions must be remitted within the Government approved times lines (7 days after salary has been credited) and the right documentations maintained to ease payroll reconciliation and auditing.

The features of a good payroll management system relies on clearly written and specific documents (OFFER OF CONTRACT) which contains a list of the employee's remuneration for services rendered to the organization. It also provides a summary of the entire emolument paid to the employee within a specific period.

A payroll system entails the following:

✔The company's remuneration strategy which includes leaves, deductions, bonuses.

✔ It also entails detailed salary and wages breakdown.

HOW TO PROCESS PAYROLL:

✔ Calculate payroll taxes- Here you calculate tax (PAYE) using the new finance at 2020.

✔Determine deductions- Statutory deductions are therefore calculated. The common deductions are Pension, NSITF, NHF, PAYE, ITF (This deductions are dependent on items your company deducts). You will also consider loans and other deductibles.

✔Calculate net pay- After all necessary deductions have been made, whatever is left constitutes the net pay of the employee.

✔Get approval of the payroll- After the necessary checks and double checks in order to avoid having payroll errors. It is important to get the payroll approved.

✔After all approval have been sorted out, you can now send the approved schedule to the Account/Finance team for payment to various employee account.

✔Payslip is issued to all employees through their official email after salaries have been credited. The payslip typically shows the gross salary, deductions made from the gross salary and the net pay to the employee.

I will continue on the risk associated with payroll on my next post.

Do you desire to be promoted at work? Then check out these 10 habits of people who get promoted at work...

👉 They Take Initiative

Taking the initiative to take on tasks and projects, volunteering for new opportunities, and finding creative ways to solve problems are all examples of how you can show your boss that you're ready for bigger things

👉 They Are Reliable

If you want to get promoted at work, you need to be reliable. Showing up on time and meeting deadlines are obvious ways of demonstrating your reliability--but so is following through on commitments. If you say that something will be done by a certain date, then it should be done by that date--and if it's not because of circumstances beyond your control (like an unexpected illness), let your boss know as soon as possible so they can plan on it.

👉 They Build Relationships

In order to get ahead, you need to build relationships with your colleagues and managers. This can be done in a number of ways: networking with people who have the power to promote you; engaging with colleagues on projects; showing respect for others; and being a team player rather than focusing only on yourself.

👉 They Take Responsibility

Taking responsibility for your actions and work is an important part of being promoted at work. You need to be able to acknowledge mistakes, learn from them, and own up to your actions. This shows that you are willing to grow and improve as a person and employee.

👉 They Show Professionalism

They dress appropriately. They communicate professionally. And they behave in a courteous manner, too!

👉 They Are Self-Motivated

You know that coworker who always seems to be doing something for the company, but never asks for anything in return? That's because they're self-motivated and not afraid of taking initiative.

👉 They Are Adaptable

They are open to change. They embrace new challenges. And they're flexible in their approach to work and life in general, which makes them more adaptable than their peers who aren't as willing to take risks or try something new.

👉 They invest in their personal growth

If you want to get promoted at work, it's important that you take charge of your own personal development by learning new skills, setting personal goals and staying organized so that no task is too big or small for you.

👉 They always take the lead

👉 They Are Committed to Excellence

They are committed to excellence in all tasks. They pay attention to detail and constantly strive to improve.
