I did, which is why I am asking for the provision in the law that stipulates a child can acquire citizenship after 10 years. I have worked with many refugees in SA and never came across that law for their children that were born in the country.

However, your child will not be granted automatic SA citizenship unless either you, or your wife is a South African citizen or have Permanent Residence in SA. Your baby will however be issued a SA Birth Certificate, and eligible to receive full citizenship at age 10.

Mr. Morpheus, pls don't be angry but do you understand English very well? The reason why i asked is not to insult you but point out the facts, even when Justwise hinted you to that regard, you failed to read the bolded exceprts of my post, which again. I have copied above.

I said a child born in SA cannot become SA citizen unless either his father or mother is a SA citizen, or if either of them has a SA permanent residency, in this case, the child is entitled to automatic citizenship. Yes, you can quote me on that one. However, if both of them are neither of the above, then the child is only eligible for citizenship status after 10yrs, this is bec

Did I mention refugees? And speakin of refugees, are u aware under certain conditions, refugees in SA can file for permanent residency? Especially after residin in SA for no less than 5 years? And as such their children can become citizens of SA.

Again, I do not mean to insult you sir.

I understood your response clearly. Please explain how a child of non SA citizens..... Non SA permanent resident who is born in SA and is issued a SA birth certificate is eligible to become a SA citizen after 10 years. In other words 10 years after holding the certificate, 10 years after residing in SA with or without their parents or when they get to 10 years old.

I would like to see the information as it is written in any law or likewise explain it to me like you would to a six year old.

No insult intended.

Manager007 is right about everything except the case of 10 years. If neither of the parent is a citizen or holder of permanent residency, such baby can only acquire citizenship through naturalisation and is deemed fit to begin processing once attain the age of 8, mind you, such person will only be issue South African ID/full citizen once 18years old according to South African Citizenship Act 1995. You can downlond the attached pdf file and read page 6.

I didn't know part of my post was largely missing.only just realized now.I'm on lunch break at work and can only type few lines as I'm using my phone.

I can only post excerpts from SA's govt homepage regardin the matter. Pls see paragraph 3 of the SA Citizenship. Ammendment Bill.

The South African Citizenship Amendment Bill will, among other things, ensure that:

A child born to a South African parent inside or outside the country is a South African by birth as long as the child is registered according to South African law.

A child born of non-South African parents but adopted by South African parents is a citizen by descent.

A child born of non-South African parents in South Africa, may, at the age of 18 years apply for naturalisation. While he or she is a minor, such children will retain the citizenship of their parents.
A child with no claim to any citizenship will be given South African citizenship in accordance with international law and practice.

Alternatively, you can visit the Goverment's. Homepage directly by clickin this link
http://www.info.gov.za/aboutgovt/home.htm

I do know for a fact that citizenship can be attained, although the stipulated 18, the clause provide or allows "minors" and in this case, under 18 are minors, hence they are eligible to apply for citizenship.

The process takes almost a year, hence itts best to apply on the child's 10th birthday. I have people that I know and have assisted to secure this citizenship benefit for their children.

And, like I said, even children of refugee status parents are eligible to apply under certain conditions.

You are more than welcome to verify all of these information by walkin into any Dept of Home. Affairs, inquire at the Citizenship Room/unit, and if u meet a knowledgeable attendant, u will be informed accordingly.

Have a nice day!

This is the reason I required the clarification on this matter. The initial question stated the benefits of a Nigerian having a child in SOuth Africa and being issued a South African birth certificate in connection with becoming a citizen of that country. The response indicated that the child would be eligible for citizenship at the age of 10 years old.

The answer should have clarified the conditions under which the child would be eligible. If the parents took the child back to Nigeria without ever residing in SA that would not fulfil the conditions in granting full citizenhsip nor if the child returned after their 18th birthday from Nigeria to claim south african citizenship, the granting thereof would be under meeting certain conditions to naturalize as well.

Therefore the benefits of recieving full citizenship as Collinsfbi points out would be under "certain conditions" such as residing in SA for a period of time under immigrant conditions such as those given to Refugees or migrants.

That is correct
Meanwhile, the conditions are as follows:
The child in question must have resided in SA for a total of four years. (NB: years spent in prison or detention not included.)
The child must reside for a continuous of 1 year before filing his/her application for naturalisation.
He/she must not be less than 8years old.

In a more simpler way, the child must have a previous total of 4years of residing within SA even if the baby will be taken away from SA, he/she can however return to file an application for naturalisation but he must reside for a continuous of 1 year before such an application can be made. Hope this helps?

I initially want to be sincere with you and tell you some things abt SA, but since you are so determined, then am speechless. Mind you, your agent will be the first person to help you waste your money.
Note: Repatriation fee is an important requirement for all foreigners regardless of your status either with employment offer or not, married to a South African citizen or not. Only citizen and people on permanent resident permit are exempted from repatriation payment (or some lucky ones who are granted tourist visa). Somehow, there are agents in South Africa who apply for work permit of different categories on behalf of applicants (talking from experience), one way or the other, some can get permit without repatriation while some are compelled to pay.

If you will listen to me, I will advise you to forget South Africa, SA is not a country where you can seek greener pasture as you have said. In your case, forget about applying for work permit in naija because you will never get it.

If you are really determined to go and financially ok, then go through the normal tourist visa, you can extend your stay on some reasonable ground probably apply for some short courses/training if you are financially capable, this will enable you to understand me very well and to decide if you really want to seek greener pasture in SA or not, experience they say is the best teacher.

As much as you want to know the truth, then I will tell you, the Immigration Act, 2002 (Act No 13 of 2002) aimed to facilitate and simplify the application and issuing process of permits, as well as regulate immigrants by making sure that they adhere to certain criteria. As a result of this, Home Affairs, decided to give legal right to various immigration practitioners who are registered with the Department to assist immigrants in putting together their applications for the different type of permit that they need. In this regards, some of these practitioners (known as agents) do get permit of different kinds for immigrants without paying the repatriation and this depend largely on their inner connection. I have met with some and they charge btw R5k-R7k but I will never advice anybody to do that. There is nothing like doing the right thing to get the right result to avoid immigration problem in the future

Re: General South Africa Visa Enquiries by Manager007: 12:56pm On Sep 23, 2012
Pappy2000,

firstly, every human being has a right of migration. you are entitled to freedom of movement. Wherever you choose to go is entirely up to you provided you do so properly and seek adequate knowledge about the country you are migrating to.

Collinsfbi has been very generous by telling you the absolute truth about possible relocation to SA to seek greener pastures. Yes, its true that SA's economy is better than Naija's. its also true that there are so many opportunities here as compared to Nigeria. However, the fact that you are a Nigerian will definitely count against you in this country.(i mentioned this in one of my earlier post). You may even begin to feel this Naija-phobia from the moment you disembark from the plane at OR Thabo airport in Johannesburg from the Immigration official.

The main reason why things may be difficult here for is simply because of your nationality and largely because you are an African Immigrant. SA isn't friendly to immigrants from other parts of Africa, except of course for countries like Botswana, Namibia etc. Nigerians, especially are the most feared of these immigrants laregely because of what some of our brothers who arrived SA so many years ago have laid a bad precedence. When you mention Nigeria, the first thing that comes to mind is Drugs, Fraud,Forgery and all other nefarious activities. It has become common thing to read and watch Nigerians being burst for crimes in newspapers and on tv. Sometime ago, some naija guys were burst by the elite Hawks unit for the "UK lotto scam" where they had taken money from an unsuspecting school principal, but still wanted more and asked her to meet her in a hotel..also, another was shown on tv for doing "wash wash money" and even claiming his father is a minister in Nigeria and taught him the fraud.

You can get SA work permit with or without hassles, but thats the first hurdle. I guarantee you, whenever you apply for jobs (especially blue-collar jobs), you will scrutinized more than the other candidates for being a Nigerian.

All SA can offer you is a relative stable electricty, food (yes, food is cheap), modest living and women. Southie women just love their Nigerian men.. When you arrive, you go see..

Another thing, you should know since you say you wanna use SA to transit to other countries, its no longer so easy, because foreign embassies here have also been hit with forged docs submitted from some scrupulous naija applicants, hence, when you present your naija pali, they will scrutinize all docs you submitted throughly before deciding to issue a visa to u, if they feel you deserve.

Botswana, may be a rich country, but it depends largely on SA economy. lots of Botswana students are sponsored by their government to come study in SA and they all (in most cases) always return home after studies. Even if you have Botswana visa, at the port of entry or border, be ready for thorough questioning from immigration official as to why you are visiting their country. Botswana women are beautiful, and they like naija guys so much, strictly because of our sexual prowess (like they claimed), but be mindful that they also have a high HIV incidence rate as well. one thing is sure, if SA has nothing to offer you, be sure there's nothing happening in Botswana for you. Except studying.

Things can only become slightly simpler if you study and complete a degree in this country. You should be able to get a decent job in that regard. Lots of naija people are employed in good-paying sectors like engineering, medicine, education etc. While, a large majority are engaged in trading or hussling to survive. A trip to Sunnyside in Pretoria will convince you. Or visit Hillbrow in Johannesburg. A lot Nigerians started like you with high hopes of making it in SA upon arrival, only to regret wasting so much money not properly investigating their immigration plans. Boys go tell you here.

With the N600k you have, why not visit and buy things for immediate sale in naija upon your return?

Naija no easy, and alot of things is messed up and i dont blame you for wanting to leave the country. It's not a bad idea actually, but why not visit SA and see things for yourself? You can decide the way forward from there. A lot

But then, the decision rests solely on you.

Thanks for taking time out to respond to my post, may the good Lord bless you.Firstly,I want to say that there is no harm in trying and the fact is that a lot of people here will discourage you from travelling,If you Malaysia they will tell you its no go area,if you say uk they wil tell you you will suffer there,if you say cairo they will tell you its for women.Sir,the chinnese have a better economy than ours yet a lot of them come here and they took the risk so I believe its worth trying.I don’t have high hopes in fact I believe I cant make break through within the first 2 years of my arrival if I stay and anywhere I go even if its Botswana I still believe I am going to face initial hurdles and I also know my nationality counts against me like you have said inyour previous post but one thing is sure if one can preserve those initial challenges then I believe one can make it there.the problem I have with Nigeria is that I no longer believe in the Nigerian Project, here if you are truthful you will be punished so that is my bone of contention and I am tired of bad news daily. You wrote in one of your previous post that one can get a quickie job like security in some places,I am not looking for a job really becos I have some little investment I can fall back on in Nigeria in terms of monthly property rent which might not be enough so I believe if I can use that and get a dirty job and seek new frointers then I believe that on the long run things might be better,I have my strategy which I believe will work but I need your support and the support I need is that I want to be adequately informed about the challenges that I will face. You have told me about the fact that my Nationality will count against me so if I get those unnecessary comments or talk I have already prepare myself for this. In term of other things that I may like face please tell me those pratical things provide I am not going to get shot just becos I am a Nigeria.I want you sir to please tell us the challenges and the possible ways of getting a solution.so please I want you to give us a pratical way of solving the issue that will may likely face,I just hope they are not violent people as in physical attack on me.I want you sir to give us pratical info on shelter, where can I get shelter,Food,Job,education and a whole lot of other things that will help us in pratical terms.Thank you sir,May God bless you,Let us talk about the challenges and the possible solutions so that I can put that into consideration. The only reason I can disembark from this is if you tell me that I will be physically harmed.

Manager007: Pappy2000,

firstly, every human being has a right of migration. you are entitled to freedom of movement.

You have done more than enough for taking your time to write all these, meawhile, no matter the level of your preaching, I don't think you can change his mind. Let him try and see for himself because experience they say is the best teacher.

If I were you, I will invest that 600k in a business in naija but since your mind is made up, I will advise you to go through the normal tourist visa, but the best you can do upon arrival is to look for a school and apply for any short courses (many short courses @unisa or any other school raging from R5k-R10k/year. Mind you Manager007 is yet to let you know that accommodation is very expensive except you have someone to share rent/utility bills with or else you will not last with your 600k after paying 18k visa fee, 110k repatriation, about 100k ticket (total 238k, balance of 362k less than $2,300). Be ready to do your permit and pay rent and program fee from your balance, all these I can guarantee you but financial continuity/stability is what I cannot guarantee. I can assure you that by the time you pay for your program fee/rent/permit, you will be left with nothing and survival becomes difficult except you have financial back up in naija but if you are relying on getting a job here, my brother you mighty up being frustrated. Think about it again and make your final decision.

Thanks for your concern.God bless you in Jesus name.I know the steps I am about to take is not a bad one.let talk a bit about the issue of security, the way things are painted here is that whenever they see u as a Nigerian its like u get shot, please can you tell me the security situation of the place.
Let talk about how much do I need to set aside for monthly allowance. Please let me know this also.from what I can see on the web I hear that cape town seems to be the best place in terms of security, but I hear that the place is equal expensive.I have heard about investing in Nigeria but please I want you to set that aside,I am no longer interested in the Nigerian Project so let forget that. The so Truth of the matter is that If things don’t work, there is nothing that says I can get back here to Nigeria. Please I want you to tell me issues bordering security, food, shelter, utility bills and what is the cost of living. How much should I budget monthly for the cost of living here. Please I need your good advice.thanks I know that you are concern that I am about to make mistake but my instinct tells me that its not as bad as you are painting it.If there are challenges how do we overcome it,not that we should just stay back.I am no longer interested in Nigeria. I hate to hear that word If I were you I will invest in Nigeria, the truth is that Nigeria is a very bad place, you must be ready to bribe your way before you can do anything,as I am talking to you I am on Generator,I have spent a lot of fuel this month. Its a pretty bad situation

smileyPappy2000,

Since you have made up your mind about relocating, i cannot but wish you all the best in your endeavour.

For starters, you need to consider your accomodation options. Accomodation is very expensive in this country. Depending on where you want to live, i wont go into details anymore as i have discussed that in prior conversations/post. in some cases, that entire N600knaira with you is what you will spend on accomodation in one year for one room here in SA. So do not be fooled into thinking N600k naira will sustain you in SA. Revisit Collinsfbi's quotation.

You need to set aside some amount to procure a permit as per your circumstance, and the amount varies. You will figure that out when you get here.

Jobs are not a guarantee anywhere in the world, but everybody's fate differs, who knows, you may succeed where others fear to thread.
Anything is possible with God on your side.

Only one warning i must give to you, as i would tell my own brother, DO NOT PUT HOPE OR RELY ON ANY NIGERIAN FRIEND, BROTHER ETC HELPING YOU OUT ENTIRELY" This is because, they also may be struggling. Just find one sweet southie babe who dey find husband, who go house or feed you..[

I wish you all the best.

In the words of the great leader, CollinsFBI "Gbam, over and out"!
